Montana reached a permanent deal yesterday that waives the Navajo Nation coal company's freedom from beingsued as a tribal entity.Navajo Transitional Energy Co. (NTEC) has now waived sovereign immunity for all the mines it bought last yearfrom bankrupt Cloud Peak Energy Inc. - the Spring Creek mine in Montana and the Antelope and Cordero Rojomines in Wyoming.The limited waivers grant the power to take the company to court only to state regulators, not environmentalgroups.And NTEC still does not technically own the mines until it secures the required cleanup insurance.The Montana Department of Environmental Quality announced the waiver just before today's self-imposeddeadline after nearly five months of negotiations.
