Greens call for fresh shot at EPA permitting policy in court

Environmental groups and states last week asked a federal appeals court to reconsider its decision preserving a controversial EPA policy shift. Judges for the U.S. Court of Appeals for the District of Columbia Circuit ruled this summer that the Trump administration's rollback of a Clinton-era air permitting policy known as "once in, always in" was not a final agency action that the court could review (Greenwire, Aug. 20). Lawyers for California Communities Against Toxics and other parties pushed back Friday against the court's finding.
