20-year-old arbitration award is enforced

"In Some ways a remarkable case" commented Lord Justice Clarke giving judgment in the Good Challenger appeal. It involved the continuing attempt by the owner of the Good Challenger to enforce a 20-year-old English arbitration award. Subsequent difficulties included the fact that Metalimportexport, the unsuccessful charterer who brought the appeal, was at the time a Romanian state-owned company (now privatised). There were proceedings in Romania as well as London, and certain differences between Romanian and English law -for example, on time bar.
