Telecom NZhas paid access seekers $NZ31.6m for discriminating in favour of its own retail arm in the provision of certain wholesale services. The settlement follows a decision by the Commerce Commission in May to issue legal proceedings against Telecom alleging that it had discriminated against other telecommunications companies - Vodafone, Orcon, CallPlus, Compass and Airnet - by failing to provide them with unbundled bitstream access (UBA) in conjunction with the sub-loop extension service (SLES) when it was providing an equivalent service to its own retail business.
