Ordinance to Require Industry Funding Of Prescription Drug Disposal Upheld

In a case that has implications for efforts to reduce water contamination from prescription drugs, a federal court has rejected a Commerce Clause claim brought by the pharmaceutical industry in an effort to block an Alameda County ordinance requiring drug manufacturers to fund disposal of such drugs (Pharm. Research & Mfrs. of Am. v. Cnty. of Alameda, N.D. Cal., No. 3:12-cv-06203, 8/28/13). In the Aug. 28 decision, Judge Richard Seeborg of the U.S. District Court for the Northern District of California held the trade groups' challenge failed to show the ordinance enacted in 2012 impermissibly burdens interstate commerce.
