Rep. Doug Collins (R-Ga.) and Sen. Chuck Grassley (R-Iowa) introduced legislation April 11 that would end the practice of federal agencies passing regulations through "sue and settle" litigation. Under the sue-and-settle approach, a private party will bring a lawsuit against an agency, alleging that the agency has failed to meet a certain requirement, such as missing a deadline for promulgating a rule. Rather than fighting the charges, agencies often settle by establishing the rules sought by the plaintiffs.
