Wisconsin Paper Firm Files Suit Demanding EPA Respond to Title Ⅴ Air Permit Petition

The Environmental Protection Agency has failed to act for more than two years on a petition by a Wisconsin-based paper company asking the agency to object to an air pollution permit issued by state regulators, according to a lawsuit filed in federal court in Green Bay, Wis. (Appleton Coated LLC v. McCarthy, E.D. Wis., No. 1:16-cv-00272, 3/7/16). Appleton Coated LLC alleges in its complaint filed March 7 in the U.S. District Court for the Eastern District of Wisconsin that EPA Administrator Gina McCarthy failed to perform a nondisrectionary duty to respond to the company's petition asking the agency to object to the Title V operating permit issued by Wisconsin regulators. Such an objection would force the state to revise the permit. The company is asking the court to compel the EPA to respond to its request.
