Earlier this decade, Fails Management Institute (FMI) documented underlying trends that would impact the direction and profitability of the construction industry during the ensuing 10-15 years. As we enter 1996, a revised and expanded list of major issues driving the industry is offered. The flow of the construction process leads to natural differences of opinion between the various participants on the building team. The traditional design/bid/build delivery process accentuated these differences into full-fledged legal and economic warfare in the 1970s and 1980s. Claims, change orders, back charges, and similar evidence of disputes dominated large segments of the industry.
