Back and Forth: Cable Not Convinced on Pole Attachment Petition

Cable players are fighting back against an electric company association’s petition asking the FCC to further clarify rules tied to refunds in pole attachment complaint proceedings. The Edison Electric Institute asked the FCC in April to clarify that in all pole attachment complaint proceedings, the applicable statute of limitations would be the same as the twoyear period set forth by Section 415(b) of the Communications Act, and that refunds in those proceedings are “not appropriate” for any period preceding good faith notice of a dispute.
