A licita??o pública como instrumento de desenvolvimento na perspectiva do paternalismo libertário.

This work aimed firstly to define public acquisition process and its purposes, especially the new purpose of promoting national sustainable development, recognized as the acquisition process’ social function. For that, we used bibliographic research methodology and deductive evaluacion method. Followed to identify the constitutionally recognized right of development, as well as the sustainability clause. Thenceforth, we dealt with the activity of promote, biased to the promotion of this right. Finally, we examined whether the state activity of promote keeps any similarity with the libertarian paternalism theory. It was concluded that the activity of promotion is consistent with what proposed by the theory of libertarian paternalism, providing a third way for state intervention in the economy.
