Historically, architects and engineers have been protected from contractors' claims for purely economic damages stemming from alleged design errors and omissions, because they enter into contracts with owners, as opposed to contractors. Without a contract, contractors were barred from suing design professional for purely economic damages, such as damages for extra work or delays. This contractual protection has been substantially eroded in many states throughout the years and the recent decision, McElwee Group v. Municipal Authority of Borough of Elverson (2007 E.Dist. Penn.) 207 U.S.Dist. Lexis 16115, is one of the latest examples of this erosion.
