As with any business, the key to survival in the construction industry is getting paid for services provided. Unfortunately, getting paid for construction work is an often difficult and time-consuming process. Many issues, such as disputes concerning extra work, delay claims, and project financing issues can impede a contractor's payment. Under US federal and state law, there are many tools, which are regularly overlooked, that a contractor can use to leverage payment from public entities. These tools include stop notices, payment bond claims, and prompt payment statutes. The recent North Bay Construction, Inc. v. The City of Petaluma case is an example of why it is crucial to know which tool to use when pursuing payment from an owner.
