Public Or Private?

A recent High Court case in October has sent shock waves around those negotiating waste contracts in the public and private sectors. Briefly, a local resident asked Nottingham County Council (NCC) for a copy of the £850m waste PFI contract agreed with Veolia on 26 June 2006. Veolia did not object to disclosure of the contract provided those parts which contained commercially confidential information were not included. The application was made under section 15(1) of the Audit Commission Act 1998 (ACA) rather than the Data Protection Act 1988, the Environmental Information Regulations 2004 (EIR) or Freedom of Information Act 2000 (FOI).
