The housing and growth initiative announced by the government on 6 September includes a package of financial measures and proposed changes to the planning system, designed to get Britain building again. Does the proposal in respect of residential developments that have stalled, due to unviable affordable housing requirements, spell the end of the Section 106 agreement? There has already been a fundamental change to planning obligations as we have become used to them over the past two decades with the introduction of community infrastructure levy (CIL).
