Final Rule Sets Policy on Sufficiency of Monitoring Requirements in Title Ⅴ Permits

In a December 15, 2006 final rule (71 FR 75422-75431), EPA established the agency's final interpretation of Title V operating permit regulations with respect to assessing the sufficiency of monitoring requirements. According to the final rule, ". . . the plain language and structure of certain sections of the operating permits regulations do not provide an independent basis for requiring or authorizing review and enhancement of existing monitoring in title Ⅴ permits [71 FR 75422]." Under the interpretation finalized in the December 15, 2006 rulemaking, state and local permitting agencies are forbidden from using the federal operating permit regulations as the basis for enhancing or supplementing monitoring requirements in Title V permits.
