Final Rule Intended to Promote Flexibility in Title V Operating Permits

On October 6, 2009 (74 FR 51418-51440), EPA issued a final rule intended to promote flexible air permitting approaches in the Title V operating permitting program. The final rule defines and clarifies the use of alternative operating scenarios and approved replicable methodologies. Including an alternative operating scenario in a Title V permit enables a source to obtain advance approval from the permitting authority to make changes to existing emission units because the facility has explained how it will continue to assure compliance with CAA requirements under the alternative scenario. Approved replicable methodologies in a Title V permit facilitate compliance with an applicable requirement in situations that otherwise could require a permit revision. For example, an approved replicable methodology might specify the testing procedure used to update an emission factor, rather than requiring a permit revision to accomplish the update.
