NOISE ACT: 1996 - Will it help you?

The Noise Act has created a new, criminal offence: the Night Noise Offence. Night is defined as between 11pm and 7am and the Act covers noise being emitted from a dwelling, including the garden, yard, outhouse or any other part of the property. The complaint must arise from an individual present in another dwelling and Environmental Health Officers (EHO) from the Local Authority covering the residence making the complaint will have to deal with the problem. The number of complaints being received annually about noise late at night has been steadily increasing over recent years, and in 1994-5, the last year for which figures are available, nearly 145,000 complaints was received by local authorities in England and Wales. It should be noted that the Noise Act, although a UK piece of legislation, does not apply to Scotland.
