李连杰壹基金转型引发的法律思考

摘要

The not-fully-developed civil public foundations in our country is facing the predicament of unclear identity, not strong credibility, and inadequate disclosure of information, primarily due to inadequate legislation, the dual management system and inadequate protection of resources within the foundation and so on. At first, Jet Li One Foundation develop to non-public foundation from charity fund plan, then transform to public foundation successfully, such tortuous process of change make people think deeply.Through the improvement of relevant foundation legislation, eliminate the dual management system, strictly regulate the information disclosure system, strengthen and improve the regulatory mechanisms, break through the constraints of development of Chinese civil public foundations as soon as possible, and create the conditions to welcome the spring of civil public foundations’ development.%民间公募基金会在我国不甚发达,面临着诸如身份不明确、公信力不强、信息披露不充分等困境,其原因主要在于立法不完善、双重管理体制及基金会内部的资源保障不足等。李连杰壹基金由最初的公益基金计划发展为非公募基金会,再到成功转型为公募基金会,其曲折的转变过程引人思考。通过完善基金会的相关立法、取消双重管理体制、严格规范信息披露制度及强化和完善监管机制等途径,尽早冲破制约我国民间公募基金会发展的羁绊,为迎来我国民间公募基金会发展的春天创造条件。
