政府信息公开诉讼中的证明责任

摘要

Government information disclosure litigation rules of evidence are not exactly the same as in the general administrative litigation evidence rules, the existing administrative litigation proof liability provisions are not sufifcient to completely solve the problems in government information disclosure litigation. The relevance of the applicant burden of proof, information from public burden of proof and information does not exist, the burden of proof makes an analysis, make some suggestions the establishment in order of government information disclosure litigation rules of evidence.%政府信息公开诉讼的证据规则不能完全等同于普通行政诉讼中的证据规则，现有行政诉讼证明责任规定不足以完全解决政府信息公开诉讼中的问题。文章将对申请人相关性的证明责任、信息免于公开的证明责任以及“信息不存在”的证明责任作出分析，以期对政府信息公开诉讼的证据规则建立作出一点建议。
