But in the process of human resource development, many cases contrary to the human resource management appear. For example,the over exploitation of social resources has made the workers suffering from work depression, even death from overwork happens frequently. This article aims to balance the conflict between the performance-oriented human resource management model and labor rights protection, so that enterprises can get out of the trouble of tort.
