承包商工程变更调价失误案例分析

摘要

工程施工过程中往往牵扯到工程变更，在工程变更使得涉及的工程细目单价不合理或者不适用的情况下，承包商应当按照施工合同文件中相关条款赋予的正当权力，在施工合同文件约定的时间期限内，向监理工程师提出重新定价意向，报请工程业主审批。否则，承包商将丧失依据施工合同文件相关条款所能够获得的正当利益。本文通过一项工程变更的真实案例，分析了承包商失误的原因。%Engineering change often happens in construction. Under the condition that engineering change makes the involved engineering detail unit price unreasonable or inapplicable, the contractor should put forward repricing intention to the supervising engineer in accordance with the legitimate power given by the relevant provisions in the contract documents within the time limit of the construction contract documents, and report to the project owner for approval. Otherwise, the contractor will lose the legitimate interests which can be obtained according to construction contract documents. In this paper, through a real case of engineering change, the causes of the errors of the contractor are analyzed.
