国际条约的国内适用研究

摘要

国际条约的国内适用是指国内机关依照法定职权和程序将条约内容运用于具体主体和事项的活动.国际条约的国内适用以立法将条约纳入国内法律体系为前提,纳入方式有转化和并入两种.在转化方式下,国际条约的国内适用是间接适用,在并入方式下,国际条约的国内适用则可能涉及直接适用.我国现行宪法性法律对于国际条约的纳入和适用方式并无明确具体规定,这导致理论和实践出现了一些误区.%Domestic application of international treaty refers to domestic authorities applying treaty to specific subject and issue,according to statutory power and procedure.Incorporating treaty into domestic legal system is the precondition of domestic application of treaty,with two modes of transformation and adoption.Domestic application of international treaty is indirect application under transformation mode,while may be direct application under adoption mode.The cunrent constitutional law of China has no specific requirement for incorporation and application of international treaty,leading to some misunderstanding of theory and practice.
