优化长三角区域知识产权边境保护的法律环境

摘要

我国现存的知识产权边境保护立法中的基础标准与上海高技术含量、高附加值的产品贸易结构的发展需求不相适应，因此，上海国际贸易中心建设需要探索、设计出本地化、协调化、优化的长三角地区知识产权边境保护的体制及其具体内容、执法标准、执法方法。涉及边境保护环境的问题，有的可通过制定直接对策予以解决，而有的由于受到立法权的限制，难以通过运用直接针对性的方法进行解决，但可通过其他方法与途径的综合使用予以解决。%Our country's existing basic standard in legislation of the border protection of intellectual property don't adapt to the developed needs of Shanghai high technology content and high value-added products trade structure;at the same time, it has closely connection with infringement of intellectual property rights in Yangtze River delta. Therefore, the construction of Shanghai international trade center needs to explore and design local, harmonious and optimal system, specific content, law enforcement standard and law enforcement method of the border protection of intellectual property of Yangtze River delta. This border protect the environment, some can be resolved through direct countermeasures, and other problems can't be resolved through directly targeted approach due to the limitation of the legislative power, but it can't be resolved through the comprehensive use of other channels and methods.
