创新驱动下专利运营法律问题研究

摘要

Implementation of innovation driven development strategy determines the destiny of China.As one of the core systems of national innovation system,intellectual property system should play its core role in the process of innovation driven development strategy.Patent as an important indicator of national innovation,not only reflects the level of technol-ogy,but also to show its dynamic development process.Now,China shows a rapid growth in the number of patents,but there are still many operational problems of patent issues,which made us lag much behind other nations in this field.Thus, the state should legislate to protect the patent operation.%创新驱动发展战略是国家重大战略。知识产权制度作为国家创新体系的核心制度之一，在创新驱动发展战略实施过程中，应该发挥其核心支柱作用。专利作为衡量国家创新能力的重要指标之一，不仅反映出技术水平高低，而且能直观地展现技术创新能力提高情况。如今，我国专利数量增长迅速，但是专利运营方面存在许多问题，和国外相比仍有很大差距。由此，提出国家应立法保障专利运营，同时应加强专利运营布局，形成规模化专利经济体系，进而带动整个专利运营市场健康快速发展，促进科技成果转化。
