关于考试作弊适用开除学籍的法律思考

摘要

In the rapid development of education, the punishment on examination cheating is more and more severe, but it does not stop despite repeated prohibition, so a more severe measure,"school expulsion"is adopted by many schools. In recent years, many litigations on the above measure often happen and attract hot social discussion. With the measure as the breakthrough point, this paper interprets the legal conflicts between the school and student and calls for the improvement of legislation.%　　在教育事业高速发展的今天，学校对于考试作弊的惩罚力度越来越大，然而考试作弊的现象屡禁不止，针对这一问题，很多学校适用了“开除学籍”这一做法。近年来，各地陆续出现了因为考试作弊被开除学籍而引发的诉讼，学生的受教育权再次被搬上历史舞台。此类的诉讼引起了社会各界的广泛关注及法律界的热烈讨论：学校是否有开除学籍的资格？学校针对考试作弊适用开除学籍这一做法是否合理合法？由考试作弊适用开除学籍引起的诉讼法院应不应该受理？我国教育方面的立法是否完善？现阶段我们该如何解决这一棘手的问题？等等。这些都是值得我们深思的问题。本文将从学校针对考试作弊适用开除学籍这一做法切入，解读学校和学生之间的法律冲突与矛盾，进一步呼吁教育立法的完善。
