我国预防接种异常反应损害救济制度存在的问题与对策

摘要

Damage relief system of immune vaccination adverse reactions has the quality of public compensation.Our current legislation has problems such as lower legislative rate, large disparity in compensatory items in different areas, cumbersome remedy procedure and so on.To a-chieve the goal conveniently and efficiently relieving injured victims, we should rebuilt our relief system by taking the measure of raising legislative rates, establishing damage compensatory fund, setting up compensatory vaccine lists, simplifying the procedure identifying adverse reactions, compensating applying and determining procedure based on lessons from comparative law.%预防接种异常反应损害救济制度具有公共补偿性质。我国现行预防接种异常反应损害救济制度存在立法规范位阶低、补偿项目地方差异较大、救济程序繁琐等问题。应在借鉴比较法经验的基础上，通过提高立法位阶，建立损害补偿基金，设置补偿明细表，简化预防接种异常反应鉴定、补偿申请及决定程序等措施加以完善，从而实现对受害者的便利、高效救济。
