中国首例冷冻胚胎权属纠纷案评析

摘要

Along with the final decision of the first ownership dispute of frozen embryos in China, extensive discussions are triggered by it, such as the legal attribute of frozen embryos and the inheritance of frozen em-bryos, etc.. Starting from the controversial focus of the case judgment, by collating related theories, this paper defines the legal status of frozen embryos scientifically, and states clearly that the relatives of the dead has spe-cific personality interests over frozen embryos. Therefore,under the premise of no violation of disgraceful consid-eration, we should give the relatives of the dead a limit supervision and disposition right, so as to realize the protection of frozen embryos.%围绕我国首例人体冷冻胚胎权属纠纷案的终审判决，引发了对于人体冷冻胚胎法律属性、冷冻胚胎能否被继承等问题的广泛讨论。本文从该案例判决的争议焦点入手，通过整理相关的学说来界定冷冻胚胎的法律地位，明确死者家属对冷冻胚胎享有特定的人格利益；并认为由此而在不违反公序良俗的前提下，应对死者的冷冻胚胎赋予其家属一定限度的监管权和处置权，从而实现对冷冻胚胎的保护。
