复制权合理使用在盈利型学术机构图书馆的适用性研究

摘要

随着盈利型学术机构的增多，这些机构的盈利性本质使其图书馆在著作权法适用方面处于一个合法的灰色地带，尤其在合理使用方面。文章通过借鉴国外的案例并结合相关的国内外立法，分析研究复制权的合理使用在这些机构中的适用性，以及具体的适用策略，从而可以使学术型的图书馆能够在盈利型的学术机构范围内充分适用复制权合理使用。%For-proift institutions are seeing a steady increase in applicant and enrollment. The property of for-proift has made libraries related to these institutions in a legal gray area in terms of copyright law, speciifcally with regard to fair use. Based on case analysis and related legislation, this paper have studied the applicability of fair use of reproduction and applying strategies in these institutions, so that academic libraries can adequately enforce fair use of reproduction within the conifnes of the for-proift academic library scheme.
