国外重要数字资源许可协议条款比较研究

摘要

文章选取了15个有代表性的外文数据库许可协议作为研究对象,分析了国外数字资源许可协议条款的主要内容,并对许可协议的核心条款即文献传递、课堂教学、长期保存、责任免除及统计数据等进行重点分析,最后从个体、行业和法律三个层面提出了许可协议合同签订的建议,即认真比较分析合同全部条款、制定数字资源许可协议模板和强化图书馆著作权例外研究.%This paper selects the 15 representative license agreement of foreign database as the research object, analyzes their main content of the terms of the agreement, and discusses the core content of the license agreement terms, namely, document delivery, classroom teaching, long-term preservation, exemption from responsibility and statistical data. Finally, from three aspects of individual, industry and legislation , it puts forward suggestions of license agreement contract ,namely, comparative analysis of all contract terms carefully, making digital resources license agreement template and strengthening the research of library copyright exception.
