国际投资法的社会化趋势探析

摘要

International Investment Law system is currently under a turn toward socialization.Transnational investment is highly embedded in the social structural and domestic regulation framework in host state,and therefore International Investment law is of great social effect in host state,including Spill -over Effect and Crowding -out Effect.Beyond tra-ditional investment protection and investment liberalization provisions,International Investment Law incorporates more and more socialized provisions to response to the negative social effect of International Investment Law in host state to so-cial interests and public policy.The socialization of International Investment Law reveals the rational interactions of stakeholders,among which the great powers in the central of International Investment Law system are critical to such transformation of socialization.%阐析国际投资法社会化趋势的规则表现，动力机制及其中的大国问题；认为国际投资协定越来越多包含传统投资自由化和投资保护之外的条款，以更多回应外国投资引起的或与外国投资直接相关的社会利益保护事宜；主张国际投资法社会化趋势是国际投资法体系下各利益相关者理性互动的制度反应，国际投资法社会化趋势从抽象规范落实为具体规则仍有赖于处在国际投资法体系中心位置的大国的示范和支持。
