在职务侵占罪入罪门槛大幅提高的现实语境下, 对快递员窃取快件等侵财犯罪的定性应立足于职务侵占罪不转移占有的本质属性, 对"职务"的认定应考察其有无包含具有代为保管性质的内容, 认定"占有"时则需重点关注有无占有辅助的情况, 并结合快递服务运作流程特点作出准确认定.%In the realistic context of raised standard of convicting crime of professional embezzlement, it is necessary to precisely determine the crime committed by deliverymen by judging whether he or she transfers the essential attribute of possession, to determine the "profession" by seeing whether he or she is related with escrow nature, to determine the "possession" by seeing whether he or she has other possession-related phenomena and referring to features of express delivery procedure
