土地生态安全法治建设——论我国土地节约政府管制立法研究

摘要

现有土地节约政府管制立法规定比较零散、不健全,且大多制定于计划经济时代,无法满足节约土地的实际需要。改革对策主要包括：合理配置土地所有权、管理权和经营权,分别由不同的权利主体来行使;提高存量土地利用效率;控制增量土地供应;改革土地管制制度;合理选择激励工具等。%Existing government regulation of land conservation legislation is not perfect,which can not meet the actual needs of land conservation.Reform measures include： rational allocation of land ownership,control rights and management rights;increase the efficiency of stock land use;control supply of increment land;reform the law system of land control;a reasonable choice of incentive tools.
