保险诈骗罪的立法缺陷及汽车保险欺诈的防治

摘要

我国保险欺诈的形势非常严峻,车险赔款中有约20%的赔款属于欺诈索赔,保险欺诈成了我国保险业健康发展的重要威胁。分析保险欺诈罪的犯罪主体、犯罪客观、量刑标准及犯罪认定等方面的立法缺陷,提出相应的完善建议,并从八个方面探讨保险欺诈的防治措施。%The insurance fraud in China is extremely serious in contemporary society. About 20% of compensation in the automobile insurance is fraud indemnity. Insurance fraud threatens the healthy development of insurance indus- try. This paper analyzes the legislative flaws in insurance fraud crime from such perspectives as the crime subject, crime objective, penalty criteria and crime adjudication ,and proposes some suggestions to improve the situation ,and then explores the prevention measures of automobile insurance fraud from eight aspects.
