论基层警察行政执法的困境与出路

摘要

The difficulties of the law enforcement activities of grassroots police include by the shortage of policemen and the misconduct of configuration;wea-kening of law enforcement procedures,simple means,the arbitrary of ruling and general ultra law enforcement;material security plight of welfare inadequate and poorly equipped;and the loss of police interests.The causes of the plight are the characteristics of social transformation in the law enforcement environment,in-adequate law enforcement norms and the arbitrary of law enforcement body.Rational way out of the grassroots police enforcement activities is to improve the security and the supervision of law enforcement.The security of law enforcement include： to improve laws and regulations to strengthen the legal security of law enforcement;to increase financial input to strengthen the material security of law enforcement;and to improve the quality of personnel to strengthen the human resources security of law enforcement.The supervision of law enforcement include： to strengthen internal supervision in public security organs;to improve the supervision of supervisory authority;to strengthen the supervision functions of the authority;to implement the police to the public;and to establish a sound accountability system.%基层警察执法活动面临的现实困境包括警力不足和配置失当的困境;执法程序弱化、手段简单、裁定随意和越权普遍的执法行为困境;福利不足和装备落后的物质保障困境;以及警察权益缺失的困境。产生困境的原因包括执法环境上的社会转型期特点、执法规范上的不足和执法主体上的随意性原因。基层警察执法活动的理性出路在于完善执法保障和健全执法监督。执法保障包括：完善法律法规,加强执法的法律保障;加大财政投入,加强执法的物质保障;提高人员素质,强化执法的人力资源保障。健全执法监督包括：加强公安机关内部执法监督;完善监督机关的执法监督;强化权力机关的监督职能;实行警务公开;建立健全问责制等。
