The Cross-Straits Agreement on Investment Protection and Promotion was concluded mainly subject to the cross-strait political reality rather than the economic logic of benefit maximization, and it demonstrates a kind of characteristic of “low standard”:a relatively low guarantee on investment protec-tion and a general elastic promise on investment promotion, and the constitutive balance between the different claims of both sides on investment protection and promotion has not be reached.For a quite long time in the future, as the political consideration on the cross-strait relations is expected to continue, the specific log-ic of the existing cross-strait investment agreement wil not be changed substan-tively.However, the effect of economic element on the cross-strait relations may tend to increase, so as to produce some impacts on the fol owing-up negotiation and interpretation of the cross-strait investment agreement.%《海峡两岸投资保护和促进协议》的达成并未完全因循经济利益最大化之逻辑,而是受制于两岸关系的政治现实,其形成的是一种“低标准”的特殊样态:在投资保护方面采取较为低度的保证和在投资促进方面实行普遍的弹性承诺,而且在这两方面两岸的不同关切实际上也未达至结构性的平衡。在今后相当长的一段时间内,两岸投资关系中的政治考量还将继续存在,现有两岸投资协议的特殊逻辑不会发生实质性的改变。但是,今后,经济因素对两岸投资关系的影响可能会增大,由此将给该协议的后续谈判以及解释带来影响。
