论信息法学的学科地位及其归属

摘要

信息法学已是信息社会迫切需要的学问，实践中与此相关的信息立法、司法、学术研究与高校课程教学也有所展开。但是，由于其学科地位未得确立、学科归属不明，这不仅导致一些课程开设与学术研究的模糊与混乱，还阻碍了信息法学的纵深发展，不利于从信息法治的角度为我国的信息化进程提供有力保障。因此，应赋予信息法学独立的学科地位，并将其归属于法学学科、定位为新兴的二级分支学科。%Information law has become a most urgently needed study in information society.Legislative,judicial,aca-demic research and teaching in colleges and universities about it have been carried out in practice already.However,the subject status of the information law study has not been established and the category of the information law study is unde-fined.It causes a state of fuzzy and chaos on some courses and academic research and hinders the further development of information law study.This situation is not conducive to provide strong guarantee for our country’s informatization from the aspects of the rule of information law.Therefore,information law study should become one independent legal subject. In other words,it should become a secondary discipline which is newly-developing.
