追续权立法研究--以艺术市场信息获取障碍为视角

最新公布的《著作权法》修改草案首次在我国规定了追续权制度，引发了不少争议。现有研究忽略了追续权制度背后的信息获取障碍，即艺术市场的“秘密性”使得艺术品转售的信息非常难获取，然而，这些信息又是运行追续权制度所不可或缺的。我国应当在追续权制度的基础上创设艺术市场的“信息获取权”和信息登记制度，以缓解艺术市场信息获取障碍的症状，保障追续权制度的有效运行。%The latest published draft of Copyright Law Amendments adopted the system of resale right.This system caused a lot of controversy.Current research ignores the information problem which makes the art market very difficult to obtain information.However,this information is indispensable for the system of resale right.China should create the art market “right to information”and information registration system to ensure the operation of the system of resale right.
