论《反假冒贸易协议》对我国的影响

摘要

2010年《反假冒贸易协议》最终文本确定，作为一部与贸易相连的新的知识产权国际执法标准，其必将对我国的对外贸易产生影响。研究《反假冒贸易协议》，分析它比《与贸易有关的知识产权协定》提高了哪些标准，总结我国法律中涵盖了多少《反假冒贸易协议》规定的新的标准，论证《反假冒贸易协议》的不合理规定，并总结《反假冒贸易协议》对我国的启示非常重要。通过分析论证，笔者认为《反假冒贸易协议》对我国的影响没有预期的大，因为我国法律法规已经囊括了大部分《反假冒贸易协议》确定的新标准。但是《反假冒贸易协议》对未来的国际贸易和我国知识产权保护的影响不客忽视。%Anti-Counterfeit Trade Act （ACTA） consolidate text was issued in Decemeber, 2010, which the new intellectual property enforcement will definitely influence China. It is the time to study ACTA to analyse ＂the higher standards＂ comparing to Trade Related Intellectual Property Rights （TRIPS）, to make a con- clusion that how much of ＂the new standards ＂ had already been in Chinese rules and regulations, to argue the unreasonable ＂new standards＂ of ACTA, and to gain reflections from the ACTA . It is concluded that the ACTA hasn t have as much influence on China as expected, but which can not be ignored upon ex- pounding and proving.
