设计-建造项目中工程师权力与承包商责任的关系研究

摘要

In international construction project,the engineer is an important participant. Based on FIDIC design-build conditions of contract,this paper comprehensively analyzes the sources of the engineer's authority,also states that the authority of the engineer is represented as the project administrator authorized by the employer and the quasi arbitrator. This paper further illustrates through a case study that the check,confirmation,approval and other conducts by the engineer can not release contractor's responsibility under the contract.%在国际工程项目中,工程师是重要的合同参与方.基于FIDIC的设计-建造合同条件,全面分析工程师权力的来源,阐述工程师的权力主要是通过业主授权的项目管理者以及第三方的准仲裁员体现,案例分析还进一步说明工程师的审查、确认、同意等行为并不能解除承包商所应承担的责任.
