再谈海运提单中的管辖权条款问题

This article analyzes the legal effect of the jurisdiction clause in the ocean bill of lading according to priority from the following three layers： the mandatory stipulation, the discretionary stipulation, the parties＇ free agreement which will constitute contractual obligation. At the same time this article investigates some special factors which will influence the legal effect so as to benefit the discuss and settlement of these problems.%从构成合同义务的法律强行规定、法律的任意规定及当事人的自由约定三个层面，依次剖析海运提单中的管辖权条款的法律效力问题，同时探讨影响该种效力的一些特别因素，以期有益于这些问题的研讨与解决。
