2011年7月,国际海事组织表决通过了《73/78防污公约》附则六修正案,为部分新造船舶制定了新的能效技术标准。该修正案是国际层面制定的第一项同时适用于发达国家和发展中国家的强制性行业减排国际法律文件,没有遵循“共同但有区别的责任”原则,必将对气候变化国际谈判走向及各国造船和航运业产生重要影响。中国作为发展中国家的海运大国,在减限排问题上将面临更大压力,对相关谈判进程中的焦点和难点问题,必须进一步加强研究,妥为应对。%The amendment to MARPOL 73/78 Annex VI has been approved recently and sets a new technical standard for GHG emission from some type of newly--built ships. As the first mandatory legal document for reduction of gas emissions at international level that applies both to developed and developing countries, the above amendment does not adopt the principle of common but differentiated responsibilities and will accordingly have important impact on both international negotiations on the change of climate and the shipbuilding and shipping industry. China is a developing country as well as a big shipping state; it will surely face more pressure on the issue of reduction of greenhouse gas emissions after the approval of the above amendment. It is suggested that the key issues during the relevant negotiation process should be further probed and well handled.
