基于公民信息获取权保障的国家保密制度——美国联邦保密制度及启示

摘要

After reviewing the American secrecy system with the historical research method,the paper came to a conclusion that the trend of this system is to loose the control of the government information and facilitate citizen＇s right of access to the government information,which is also the basic requirement all over the world.The newly enacted Secrecy Act in China still stick to keep government information secret ftirther,which will damage citizen＇s right of access to government information.Our secrecy system should be established based on the protection of citizen＇s right of access to government information.%运用历史主义的研究方法对美国联邦保密制度进行梳理,并对其内容进行分析,指出美国联邦保密制度的发展总趋势是放松对政府信息的管制、有利于公民获取政府信息,这是各国保密制度的基本要求。我国新《保密法》已颁布实施,但该法的立法宗旨和价值取向是进一步加强保密,这必然不利于公民获取政府信息权,应基于公民信息获取权保障构建我国的保密制度。
