Assimilated Mortgages Under the Romanian Civil Code

摘要

Under the law no. 287/2009 on Civil code (the "Civil Code"), has been preserved the concept establish under the law no. 99/1999 regarding certain measures for speeding up the economical reform that a mortgage can be establish over a certain asset through ad-hoc measures, expressly regulated in this respect, as well as through any other method, making a difference between mortgages and operation assimilated to mortgages [1]. The purpose of this study is not to cover exhaustively the problem of assimilated mortgages but rather to present some practical implication of this legal institution and certain solutions used in practice.
