WHEREAS, MoDOT and KDOT have undertaken a bi-state Intelligent Transportation Systems (ITS) program called Kansas City Scout, which operates a Traffic Management Center (hereinafter referred to as "TMC") at its offices in Lee's Summit, Missouri; andWHEREAS, MoDOT and KDOT are the owners of Intelligent Transportation (IT) Infrastructure constructed along segments of the Missouri and Kansas highway system in the Kansas City area and has produced and produces transportation related information that is used for the purpose of Intelligent Transportation System (ITS), generally known as "Kansas City Scout", and in which MoDOT and KDOT own certain rights, title, and interests related thereto, including copyrights; andWHEREAS, Kansas City Scout has trademark registrations on marks hereinafter identified as the "Kansas City Scout Logo", in accordance with the requirements of Title 15 U.
