On Criminal Law Protection of the Environment and Resources in the Perspective of Sustainable Development in China

Adhering to sustainable development is an important measure of implementing the scientific development in China. The protection of the environment and resources is the important factor and basis of achieving sustainable development. There are many measures to protect environment and resources and protection by criminal law is an indispensable and the last measure because criminal penalty is the most severe penalty sanction. The environment and resources have been protected to some extent in criminal law in China but it is inadequate. There are many defects on the legislative standards, the scope of protection, the elements of crimes, the preventive protection and so on in our criminal law about protection of the environment and resources. In order to further promote sustainable development, China should perfect the criminal law to protect the environmental resources.
