This paper presents the time-dependent and strain-rate-dependent stress-strain behaviour of soils in 1D straining and in triaxial stress conditions. It is noted that the time effects and strain-rate effects are significant and shall be included in constitutive modelling and analysis of deformation (settlement). A few important technical terms are discussed. A nonlinear creep function is introduced and is suitable for most clayey soils. Both 1D and 3D Elastic Visco-Plastic Models (EVP) are briefly presented. The paper presents the applications of the two EVP models for 1D and 2D consolation analysis. It is found that the excess porewater pressure is increased in the initial period of time. This phenomenon is caused by the creep compression of soil skeleton.
