Waste contracts were originally based on building and construction contracts and through the passage of time evolved into complicated documents incorporating provisions from a variety of sectors. Unenforceable penalty provisions were commonplace and provisions requiring the contractor to assume all the risks associated with the project, for no extra cost, resulted in the private sector either suffering significant losses from such contracts or declining to bid in the first place.
