BasicMed CFI Safety Pilot

Just quickly read the "BasicMed Safety Pilot" article in the May issue. BasicMed Safety Pilot must be named PIC. Got it. What if the right seat safety pilot is a CFI with BasicMed? He "technically" is not giving instruction but then the scenario of "naming" the right seater with BasicMed as PIC is in the same boat. Might be a can of worms best left unopened.
