The U.S. District Court for the Eastern District of Pennsylvania ordered HUD to waive fees for the production of documents requested by a nonprofit organization under the Freedom of Information Act (FOIA), 5 U.S.C. Section 552 et seq. (Community Legal Services, Inc. v. U.S. Department of Housing and Urban Development, No. Civ.A. 04-CV-3474, 2005 WL 3481317 (E.D.Pa.), December 19, 2005). Community Legal Services, Inc. (CLS), which provides free legal services to low- and moderate-income residents of Philadelphia, sought the documents in connection with the Section 8 Moving to Work (MTW) program operated by the Philadelphia Housing Authority (PHA).
