The District of Columbia Tenant Opportunity to Purchase Act (TOPA) allows tenants to assign their rights to purchase to third parties, ruled the District of Columbia Court of Appeals, upholding the sale of an apartment building to such a third party. (Allman v. Snyder, No. 04-CV-424, 2005 WL 3434372 (D.C.), December 15, 2005). Roy Snyder, the personal representative of the estate of Jeannine B. Ulmer, entered into a contract with Todd W. Bissey to sell a four-unit apartment in Ulmer's estate. Under the TOPA, Snyder notified existing tenants of the cash offer. After the statutory 15-day period, tenant Elizabeth Allman submitted a statement of interest in purchasing the property.
